Statute
The following Regulations define the general terms and conditions of sale applicable in our online store available at https://besimo.eu, operated by BESIMO Robert Kornak, Jana Pawła II 14/4, Syców 56-500, NIP: 9112030904, REGON: 383206526. The business activity is registered in the Central Register and Information on Business Activity (CEIDG), maintained by the Minister responsible for the economy.
1. Scope of application of the regulations
The Regulations apply to all orders placed by Consumers and Entrepreneurs via our online store.
Pursuant to Article 22 of the Civil Code, a consumer is a natural person who concludes a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
According to Article 43 of the Civil Code, an entrepreneur is a natural person, a legal person or an organizational unit that is not a legal person, but which is granted legal capacity by law and conducts business or professional activity on its own behalf.
Other or supplementary Regulations and General Terms and Conditions used by Entrepreneurs do not apply – they will only become part of the contract if we give our express written consent.
2. Conclusion of the contract
The sales agreement is concluded with BESIMO Robert Kornak.
The presentation of products in our online store constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code. To make an offer to purchase products, you must place an order. Using the mechanisms available in our store, you can add selected products to your shopping cart and submit a purchase offer. You can modify the shopping cart and the data entered in the forms before placing your order, using the available functionalities and messages displayed during the ordering process.
By clicking the button on the order summary page to confirm and finalize your order , you place an order for the products in your shopping cart. After placing your order, you will receive an email from us confirming receipt of your order and its acceptance for processing. Upon receipt of this email, a sales contract is concluded.
3. Language and rules for consolidating the contract

We retain the contract and send you order details and our Terms and Conditions by email. You can also view information about your orders through your customer account. The Terms and Conditions are also available on our online store's website, allowing you to retrieve, reproduce, and save their content.
4. Delivery of products
Shipping costs must be added to the indicated product prices. Ordered products are delivered via our partner courier companies. Detailed information about available delivery methods, times, and shipping costs is provided during the order process and on our store website.
The products offered in the store are sold exclusively via mail order. Unfortunately, in-person pickup is not available.
5. Payments
The following payment methods are available in our online store:
- Payment on delivery upon receipt of the shipment.
- Electronic payments (e-payments) via an online payment service.
- Payment is by traditional bank transfer to our store's bank account. If you choose this payment method, we will email you the bank transfer details after placing your order. Order processing will begin once the full amount of the required payment has been credited to our account.
Detailed information about possible payment methods, including online payment services integrated with our store and available e-payment types as well as possible additional costs, is presented during the ordering process and on our store website in a special information tab regarding payment methods.
6. Right to withdraw from the contract
Consumers have a statutory right to withdraw from the contract, in accordance with the information contained in the instructions on the right of withdrawal.
The right to withdraw from a contract also applies to individuals entering into a contract directly related to their business activities, if the content of the contract indicates that it is not of a professional nature for them, in particular arising from the subject of their business activity, as disclosed under the provisions of the Central Registration and Information on Business. Other entrepreneurs do not have the right to withdraw from a contract.
7. Reservation of ownership of goods
Products ordered in the store remain our property until full payment of the sales price.
8. Damage caused during transport
For Consumers: In the case of consumer distance purchases, our store always bears the risk of accidental damage or loss of goods during transport. If the ordered products are delivered with obvious damage incurred during transport, we kindly ask you to report this defect to the carrier as soon as possible and contact us. Delay in filing such a complaint or contacting us will not affect your statutory rights (described below in the section on complaints) or their satisfaction. However, a faster notification will assist us in pursuing our claims against the carrier or transport insurer.
9. Complaints: compliance of the goods with the contract / defects
Applies to Consumers : We are obligated to deliver goods free from defects. If the goods do not conform to the contract, the Consumer has the rights specified in Chapter 5a of the Consumer Rights Act. Under the terms specified therein, the Consumer may request the repair or replacement of the non-conforming goods, submit a declaration requesting a price reduction, or withdraw from the contract. We are liable for any lack of conformity of the goods with the contract discovered within two years of their delivery, unless we have specified a longer expiration date for the goods, in which case the longer period applies.
In the event of non-conformity of the goods with the contract, the above provisions regarding the Consumer also apply to a natural person concluding a contract directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Register and Information on Business Activity.

Information regarding any additional warranty and its detailed terms and conditions are always included with the product and available on the information pages of the online store.
Applies to Entrepreneurs: (with the exception of natural persons concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for these persons - so-called "quasi-consumers", i.e. sole proprietors exercising certain consumer rights): in the case of a sales contract concluded with an Entrepreneur, pursuant to Art. 558 § 1 of the Civil Code, the liability of our online store under the warranty for defects is excluded.

10. Services provided electronically
To use our online store, including browsing our products and placing orders, you must have a multimedia device with an installed web browser and access to the internet and email. It is recommended that you enable JavaScript and cookies in your browser settings. Users are required to use the online store in a manner consistent with the law and good practice. Providing illegal content is prohibited.
We take all necessary measures to ensure the proper operation of our website and online store interface based on current technical knowledge and are committed to resolving any irregularities and technical issues reported by users within a reasonable timeframe. This also applies to newsletter subscriptions or the optional ability to create a customer account – if these services are provided within our store. You can notify us of any detected irregularities or interruptions in the operation of our website and online store services using the contact details provided above. In complaints regarding irregularities related to the technical operation of the online store website, please indicate the type and date of the irregularity.
11. Extrajudicial dispute resolution
We hereby inform you that consumers have the right to use out-of-court complaint and redress procedures. Information on how to access these dispute resolution procedures can be found at the following address: www.uokik.gov.pl, in the " Amicable Resolution of Consumer Disputes " tab.
Additionally, at: http://ec.europa.eu/consumers/odr Consumers have access to an online platform for resolving consumer disputes (the so-called ODR platform). The ODR platform is a multilingual, interactive website serving consumers and businesses seeking out-of-court resolution of disputes arising from distance sales contracts or service contracts.
The use of the above-mentioned extrajudicial methods of claim settlement and dispute resolution is voluntary and may only take place if both parties to the dispute (Consumer and Seller) consent to it.
12. Final provisions
None of the provisions of these Terms and Conditions are intended to violate the statutory rights of consumers. In the event of any conflict between the provisions of these Terms and Conditions and the rights of consumers under generally applicable laws, the statutory provisions will always apply in place of the challenged provisions of these Terms and Conditions.
In the case of Entrepreneurs, Polish law applies to all contracts concluded with us, excluding the United Nations Convention on Contracts for the International Sale of Goods.
In the case of Entrepreneurs, legal entities under public law or separate public-law entities, the court with exclusive jurisdiction for resolving disputes All disputes arising from contractual relations between us and you will be resolved by the court having jurisdiction over our registered office. The preceding sentence does not apply to individuals entering into a contract directly related to their business activities, if the content of the contract indicates that it is not of a professional nature for them, in particular arising from the subject of their business activity, disclosed under the provisions of the Central Registration and Information on Business.
